Terms and Conditions

These Terms and Conditions apply to every quotation, order, purchase agreement and delivery made by Tegeldepot Suriname N.V. Any deviation is valid only when agreed in writing.
This English version is provided for international customers. In the event of any difference in interpretation between the Dutch and English versions, the Dutch version shall prevail.

IMPORTANT

Always inspect the tiles before installation for product type, colour, calibre, dimensions, quantity and visible damage. Once products have been installed or processed, they are considered accepted insofar as the defect was visible or could reasonably have been identified beforehand.

1. Definitions and applicability

1.1 In these Terms and Conditions, “Tegeldepot” means Tegeldepot Suriname N.V. “Customer” means any natural person or legal entity that requests a quotation, places an order or enters into an agreement.

1.2 These Terms and Conditions apply to showroom sales, telephone and online orders, quotations, collection orders and deliveries. The Customer’s own terms and conditions are expressly excluded unless accepted by Tegeldepot in writing.

1.3 If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in effect. The parties shall replace the relevant provision with a valid provision that reflects its intended purpose as closely as possible.

1. Offers, information and agreements

2.1 Quotations and price estimates are non-binding unless a specific validity period is expressly stated. An agreement is concluded when Tegeldepot confirms the order in writing, receives payment or begins performance of the order.

2.2 Images, samples, colour samples, displays and product descriptions provide the best possible representation. Ceramics, natural stone and granite may show variations in colour, pattern, texture, gloss, dimensions and shade. Such customary variations do not constitute a defect.

2.3 The Customer is responsible for the accuracy of all dimensions, quantities, delivery information and details concerning the intended application. Any calculation or advice provided by Tegeldepot is for guidance only. The Customer or installer remains responsible for final measurements, the substrate, installation and the required allowance for cutting waste and spare material.

1. Prices and VAT

3.1 All prices and quotations are stated in Surinamese dollars (SRD), unless otherwise agreed in writing.

3.2 All stated prices exclude 10% VAT. VAT will be listed separately on the quotation, order confirmation or invoice.

3.3 Transport, unloading, equipment, additional waiting time and other additional services are not included in the product price unless otherwise agreed in writing.

3.4 Tegeldepot is not required to supply products at an incorrect price resulting from an obvious typographical, calculation or publication error. The Customer will be informed of the correct price and may cancel the order free of charge before performance begins.

1. Payment and retention of title

4.1 Payment must be made in accordance with the payment term and payment method stated on the quotation, order confirmation or invoice. Unless otherwise agreed in writing, the full purchase price must be paid before collection or delivery.

4.2 In the event of late payment, Tegeldepot may suspend performance and delivery. Reasonable collection and recovery costs shall be payable by the Customer insofar as permitted by law.

4.3 All delivered products remain the property of Tegeldepot until the Customer has paid all amounts due in full. The risk of loss or damage shall nevertheless transfer in accordance with Article 6.

1. Stock, production batches and additional orders

5.1 Stock information is indicative. A product is only reserved for the Customer after Tegeldepot has confirmed the reservation and the agreed payment has been received.

5.2 Tiles and natural stone from different production batches may vary. The Customer must therefore order sufficient material, including an allowance for cutting waste and spare material, at the same time. Tegeldepot cannot guarantee that a later additional order will have exactly the same shade, texture, dimensions, calibre or production batch.

5.3 Delays or cancellations caused by a manufacturer, supplier, carrier, port, customs authority or government agency entitle Tegeldepot to provide a new reasonable delivery period. If delivery becomes permanently impossible, the unavailable part of the order will be cancelled and refunded.

1. Collection and delivery

6.1 Collection from Tegeldepot is free of charge. The Customer will be notified when the order is ready. The Customer must arrange suitable transport, sufficient load capacity and safe securing equipment.

6.2 Delivery is available for an additional charge. The delivery price will be determined in advance based on factors including distance, accessibility, order size, vehicle type and any special circumstances. All delivery costs are payable by the Customer.

6.3 An agreed delivery date or time is an estimate unless expressly confirmed in writing as a strict deadline. The Customer must ensure that the delivery location is safe, accessible and suitable for the delivery vehicle and that someone is present to receive the products.

6.4 Standard delivery is made to the nearest safe and accessible unloading point. Carrying products further, internal transport, lifting work or delivery to an upper floor is not included unless agreed in writing.

6.5 For collection orders, the risk transfers when the products are handed over to the Customer or the Customer’s carrier. For deliveries, the risk transfers when the products have been delivered to the agreed unloading point. Additional costs resulting from incorrect information, poor accessibility, absence or an unsuccessful delivery attempt are payable by the Customer.

1. Inspection, damage and shortages

7.1 Upon receipt, the Customer must immediately check the number of packages and inspect them for visible transport damage. Visible damage or shortages must be noted on the delivery document and, where possible, recorded with photographs.

7.2 Visible damage, incorrect products or incorrect quantities must be reported in writing within 48 hours of receipt. Other defects must be reported in writing as soon as possible after discovery. The report must include the order or invoice number, a clear description and photographs.

7.3 The Customer must not install or process products that are subject to a complaint before Tegeldepot has had an opportunity to assess the complaint. Installing or processing visibly damaged or non-conforming products constitutes acceptance of those products.

1. Returns and cancellations

8.1 Unopened and undamaged standard stock products may only be returned with prior approval within 7 calendar days after collection or receipt and must be accompanied by proof of purchase. Tegeldepot will first verify that the products are suitable for resale and originate from the supplied production batch.

8.2 Opened packages and opened stock products cannot be returned.

8.3 The following products are also excluded from returns: specially ordered products, custom-made products, processed or cut products, discontinued products, discounted clearance products, products with signs of use or transport damage and products that can no longer be sold as new due to storage or handling by the Customer.

8.4 An accepted return will be credited or refunded using the agreed method. Original delivery charges and return transport costs will not be refunded and remain payable by the Customer.

8.5 Cancellation after final confirmation is only possible with Tegeldepot’s written consent. Tegeldepot may charge the Customer for costs already incurred, products already ordered and obligations that cannot be cancelled.
